Shipping Policy
Applicable To: All purchases made through kakiba.com, whatsapp channel, and our retail stores ("The Customer").
1. Preamble
This Shipping Policy ("the Policy") sets out the terms and conditions governing the dispatch and delivery of products ordered by a customer ("the Customer," "you," or "your") from the Company. By placing an order, the Customer acknowledges having read, understood, and agreed to be bound by the terms set out herein.
2. Definitions
For the purposes of this Policy, the following terms shall have the meanings ascribed below:
- "Logistics Partner" means any third-party courier, freight, or delivery service provider engaged by the Company to effect the physical delivery of products to the Customer.
- "Working Days" means all days other than Saturdays, Sundays, and public holidays observed at the Company's principal place of business.
- "Shipping Fee" means the amount payable by the Customer for delivery, calculated in accordance with Clause 4.
- "Date of Payment" means the date on which payment for an order is successfully confirmed and processed by the Company's payment gateway.
3. Fulfilment Through Logistics Partners
3.1 The Company shall effect delivery of all products exclusively through Logistics Partners engaged and vetted by the Company for reliability, security, and service standards.
3.2 The Company shall exercise reasonable care in the selection of its Logistics Partners; however, the act of physical delivery, once handed over to a Logistics Partner, shall be governed by the operational standards and timelines of that Logistics Partner, subject to the Company's oversight and the timelines set out in Clause 5.
3.3 The Company reserves the right, at its sole discretion, to engage, substitute, or change its Logistics Partners at any time, without prior notice to the Customer, provided that such change shall not adversely affect the delivery timelines set out in this Policy.
4. Shipping Fees
4.1 A Shipping Fee shall be levied on each order, the quantum of which shall be determined by reference to the region to which the order is to be delivered.
4.2 Shipping Fees are calculated based on factors including, without limitation, the destination region, distance from the applicable dispatch point, and prevailing Logistics Partner rates for that region.
4.3 The applicable Shipping Fee for a given region shall be presented to the Customer prior to confirmation of an order, and shall form part of the total amount payable at checkout.
4.4 The Company reserves the right to revise Shipping Fees for any region from time to time, provided that any such revision shall not apply to an order for which payment has already been confirmed.
5. Delivery Timelines
5.1 Save as provided in Clause 6, all orders shall be dispatched and delivered within two (2) to three (3) Working Days of the Date of Payment.
5.2 The timeline set out in Clause 5.1 is contingent upon successful confirmation of payment and completion of the Company's standard order verification and processing procedures.
5.3 Delivery timelines are estimates provided in good faith and calculated from the Date of Payment. Where delivery is delayed on account of circumstances attributable to a Logistics Partner, regional accessibility, or matters beyond the Company's reasonable control, the Company shall use reasonable endeavours to keep the Customer informed of any material change to the expected delivery date.
6. Same-Day Delivery
6.1 Same-day delivery may, in certain circumstances, be available to the Customer.
6.2 The availability of same-day delivery is expressly dependent upon the Customer's delivery location and the operational capacity of the Logistics Partner servicing that location, and is not guaranteed in respect of any order.
6.3 Where same-day delivery is available for a given location, this shall be indicated to the Customer at checkout, together with any applicable Shipping Fee differential. Where same-day delivery is not available for a given location, the standard timeline set out in Clause 5.1 shall apply.
6.4 The Company makes no representation or warranty that same-day delivery shall be available for any particular location on a continuing basis, and its availability may vary according to order volume, weather conditions, and other operational factors affecting the Logistics Partner.
7. Order Tracking
7.1 Upon dispatch, the Company shall furnish the Customer with tracking information, where made available by the relevant Logistics Partner, enabling the Customer to monitor the status of delivery.
8. Failed or Delayed Delivery
8.1 Where delivery cannot be completed due to an incorrect or incomplete address supplied by the Customer, or due to the unavailability of the Customer or an authorised recipient at the delivery location, any resulting delay or additional cost shall not be attributable to the Company.
8.2 Where a Customer becomes aware of a delivery delay materially beyond the timeline set out in Clause 5.1, the Customer may raise the matter with the Company's customer service team, who shall liaise with the relevant Logistics Partner to investigate and resolve the matter.
9. Reservation of Rights
9.1 The Company reserves the right to amend, vary, or supersede this Policy at any time without prior notice, save that any such amendment shall not apply retrospectively to orders for which payment has already been confirmed prior to the date of amendment.
10. Governing Law
10.1 This Policy shall be governed by and construed in accordance with the laws of [Jurisdiction], without prejudice to any mandatory consumer protection rights afforded to the Customer under applicable law, which rights shall prevail to the extent of any inconsistency with this Policy.
